Woman Wins Compensation For Sex-Related Injury

By Sam Gibbs on at

This has to be one of the weirdest of those annoying personal injury claims I’ve ever heard. Having been hit on the head by a light fitting that came away from the wall while mid-session with a male friend in a motel room, an Australian woman has managed to win compensation from her employer. Apparently, because she was away from home for work she can claim, even though the act wasn’t exactly work related.

Despite having previously been turned down compensation on the grounds that “'she was involved in a recreational activity, which her employer had not induced, encouraged or countenanced,” the Australian Federal Court has ruled in her favour. Contrary to what you might think, the injuries sustained were indeed in the line of duty, even though she was doing the dirty on her own time.

According to Justice Nicholas from the Federal Court the particulars of the activity didn’t matter:

“If the applicant had been injured while playing a game of cards in her motel room she would be entitled to compensation.”

So there you have it; even if you hurt yourself while having it away on business you can claim compensation, if you happen to live in Australia that is. Mind you, it’s unknown whether the light was pulled down due to the woman’s amorous activities, or whether it was simply, err, faulty. [Metro]
