Poor Kywan Fisher just wanted to have his fill of lonely-bloke entertainment. He downloaded 10 of Flava Works’ adult movies, hooking them up to BitTorrent in the process; what a mistake that turned out to be. He’s just been ordered to fork out a cool £1 million for the privilege, the largest damages fine ever awarded, in one of only a handful of piracy cases that has actually made it to court. Don’t mess with the porn barons.
Fisher’s mistake was to be a paid-up member of Flava Works’ smut site in the first place. He legitimately downloaded the 10 pornos, but then decided they were so, ummm, good that the whole world should see them. He promptly shared them on BitTorrent for all, not knowing that Flava Works embeds its videos with the personal information from the purchaser, allowing it to instantly track the pirated videos straight back to Fisher. Ouch.
Considering Flava Works had hard evidence, and Fisher signed a contract with the smut studio against sharing the moment he downloaded the movies, it was an open and shut case. The irony is that the 10 movies Fisher shared were only downloaded 3,449 times — that’s £290 a download. Something tells me that so wasn’t worth it. [TorrentFreak]

That’s a lot of money, some places overseas $10 get you good long time, only ten dollah, you like…..
So you went to the same place as my mate Dave did.
Ahem, never been there myself, friends of friends you know, (although I did hear Dave was with a ladyboy
So. Worth. It.
He should have pirated some video conversion software first.
Yeah sorry, he deserved this.
There’s a difference between downloading music/film then buying the CD/DVD/going to the gig etc. and taking the piss. He was taking the piss.
I downloaded epic amounts of everything while I was at uni. Films, music, porn, programs.
Now, I have an awesome DVD collection, I use Spotify for my music, Netflix for TV and finally have a real live version of the Adobe Master Collection for work.
I’m now paying back into the system. It’s like a media welfare system!
In the guys defence I’m sure that if he could have gone to the gig he would have done
fwiw, its being reported elsewhere that it was GAY p0rn he shared. So your funny graphic is incorrect.
So, he’s a millionaire then?
If not then what happens next. He goes straight to jail?
If it was gay porn as stated above he might enjoy a jail term as there’s no mixed prisons to my knowledge.
how can this be fair? changing him 29x the price for each download?
thats like saying that because you caused 10k worth of damage the fine should be 290k
appeal?
he is an idiot though!
Perhaps because he’s paying for the fact that the movies are now out there and there’s several thousand people still sharing them, they’ll spread now, plus theres legal fees and all the other rubbish (oh and if the penalty for stealing £10 worth of goods was £10, you might as well steal, only MP’s get to do that sort of thing)

i guess you are right!
fixed this for you guys.

“Hard” evidence? Fnarr, fnarr….
But you say he uploaded them not downloaded them as the title.
agreed, downloading isnt illegal. its the sharing or uploading that will get you in trouble
“Downloading isn’t illegal”? I think several copyright holders would tend to disagree…
Legally Liam is correct.
its distributing that is illegal. simply clicking a hyperlink to download you are not distributing.
torrents and file shares you are distributing.
of course the news etc just refers to downloading when they mean sharing/distributing.
What actually happens when people like him get fines like this? I can’t see him ever actually paying all of it, so what happens?
Has no one mentioned that Flava actually make Gay Porn yet?
i dont think we are as knowledgeable about gay porn as you… Southern
i dont count 2+ ladies as gay porn
although i guess i should…
Not for me to have such acute knowledge of such material, sir! I was only going on what the BBC had
you dont want to know what porn the BBC has!
Does it matter?
It was missing from the summary and I was wondering how this might have affected the defendant.
if he had £1 million he’d hire porn stars and make his own movie….
just been reading that the idiot didnt even turn up to court, so was given the maximum penalties. not a lot of sympathy for him
Its not surprising the law is widely regarded as unjust when you see fines like this being levied for theft. The punishment for murder is less than having a million pound debt saddled on the rest of your life’s earnings. This is a serious distortion of the law and brings all law into disrepute and is therefore a bad thing.
