There’s a copyright notice people have been posting on Facebook over the past couple of days similar to privacy notice that made the rounds several months ago. Before you copy paste it on your own profile, stop. It’s bogus and unenforceable.
Here’s the full text of the waning post:
In response to the new Facebook guidelines I hereby declare that my copyright is attached to all of my personal details, illustrations, graphics, comics, paintings, photos and videos, etc. (as a result of the Berner Convention). For commercial use of the above my written consent is needed at all times!
(Anyone reading this can copy this text and paste it on their Facebook
Wall. This will place them under protection of copyright laws. By the present communiqué, I notify Facebook that it is strictly forbidden to disclose, copy, distribute, disseminate, or take any other action against me on the basis of this profile and/or its contents. The aforementioned prohibited actions also apply to employees, students, agents and/or any staff under Facebook’s direction or control. The content of this profile is private and confidential information. The violation of my privacy is punished by law (UCC 1 1-308-308 1-103 and the Rome Statute).Facebook is now an open capital entity. All members are recommended to publish a notice like this, or if you prefer, you may copy and paste this version. If you do not publish a statement at least once, you will be tacitly allowing the use of elements such as your photos as well as the information contained in your profile status updates…
Good thing you cited the Berner Convention. Now you’re definitely protected. Really though, you signed up for Facebook and anything you post on Facebook is basically well, Facebook’s. You’ve agreed to the terms of service, and have been asked to continually agree to them as they’ve changed and evolved. And if you don’t like it, don’t use Facebook. And definitely don’t fall for this “copyright notice.” [Mashable, Snopes]

Twitter Is the One Place the Number of Copyright Notices Is Actually Down
Facebook Copyright Law (For Idiots)
Your Facebook "Privacy Notice" Is Unenforceable Nonsense
Ah, but do the terms of facebooks service say “no backsies”?
Absolutely, it may seem like a trivial detail but if Facebook has not sealed it’s contract with the user with a least a double sealed ‘no backsies’ and can prove in an open court that they (Facebook or their legal representation) – at the time of the contract being signed by the user – had their fingers crossed to prevent their ‘no backsies’ being negated by the user – then they leave themselves open to litigation.
posts like this help highlight those on my facebook friends who are indeed truly stupid.
why keep them then?
well it helps make me feel better about myself as they make me look like a genius
Well duueerrrrrrr.
It’s the 21st Century version of the chain-letter then.
These inane attempts at legal posturing remind me of the freeman (FMOTL) movement, people with no actual expertise (and often no actual knowledge) of the law laying-down-the-law in badly written, error strew pseudo-legal missives that claim that if you simply employ the right (perhaps ‘magical’) words or some legal talisman you can circumnavigate the law.
“Hey, did you know that if you say ‘I don’t consent’ to a police officer he can’t arrest you !”
Yes, dear . . . that’s right. : )
And by the way it’s the ‘Berne Convention’ not ‘Berner Convention’.
Anyone who doesn’t know what an apostrophe is for shouldn’t post disclaimers anyway.
Shouldnt that be disclaimer’s?
Shouldn’t that be ‘Shouldn’t'?
We could do this all day.
We could…
but maybe we shouldn’t
One of my IT guru mates posted this yesterday. Seriously would have thought he’d know better.
‘Course, he is also one of those conspiracy nuts who probably thinks Snopes is working for Them.
